Terms and Conditions for Electronic Services

for the studym8.app application

§1 General Provisions

These Terms and Conditions define the rules for using the web application (PWA) studym8.app.

The Service Provider is: PENTEST Rafał Dyck, ul. Tadeusza Kościuszki 64/17, 81-198 Pogórze, Poland, NIP: 5782867795, email: kontakt@studym8.app.

These Terms are addressed to consumers, entrepreneurs, and sole traders with consumer rights.

Using the Application constitutes acceptance of these Terms and Conditions.

§2 Definitions

  • Service Provider – PENTEST Rafał Dyck.
  • User – a natural person, legal person, or organizational unit using the Application.
  • Application – a PWA-type tool (studym8.app) used for managing the education process, including exam deadlines and notes.
  • Account – an individual User panel within the Service Provider's ICT system.
  • Paid Access – a digital service consisting of unlocking data editing functions for the duration of one academic semester.

§3 Technical Requirements

To use the Application, the following are required:

  1. a device with Internet access,
  2. a modern web browser supporting HTML5, JavaScript, and Service Workers,
  3. an active e-mail address.

The Application operates on a "Local First" model, which means educational data is saved locally in the User's browser memory.

The User has the option to enable an optional data backup function on the Service Provider's server to protect data against loss.

§4 Registration and "Launch" Promotion

Registration requires providing a name, an e-mail address, and setting a password.

The User is obliged to provide true and accurate data.

The User is responsible for maintaining the confidentiality of their Account login details.

It is prohibited for the User to provide content of an unlawful nature.

50/50 Promotion: The first 50 Users who register an Account after the official launch of the Application will receive Paid Access for the first semester free of charge. Promotion is granted based on the order of registration in the system.

§5 Data and Security

Educational data (notes, subjects) is, by principle, stored locally on the User's device.

The Service Provider does not have access to the content of notes stored locally.

The User acknowledges that clearing browser memory, uninstalling the application, or device failure without an active server backup function may result in permanent data loss.

The Service Provider is not liable for data loss resulting from factors on the User's side (e.g., device damage, browser errors).

It is recommended to regularly use the data export function or enable the server backup function.

§6 Payments and Invoices

The fee for semester access is 16 PLN gross.

The payment is a one-time fee and does not renew automatically (no subscription model).

Payments are processed via PayU or Przelewy24.

Paid Access is activated immediately after payment confirmation by the operator.

Invoices: The Service Provider issues invoices upon User request. Requests for an invoice must be sent to kontakt@studym8.app within 7 days of payment, providing the necessary buyer details.

§7 Right of Withdrawal

Consumers generally have the right to withdraw from a contract within 14 days without giving any reason.

In accordance with Art. 38 item 13 of the Act on Consumer Rights, the right to withdraw from a contract for the supply of digital content does not apply if the performance has begun with the Consumer's express consent before the expiry of the withdrawal period and after being informed about the loss of this right.

By making a purchase, the User expresses voluntary consent for immediate activation of Paid Access, which results in the expiration of the right to withdraw from the contract upon service activation.

§8 Complaints

Complaints can be submitted to: kontakt@studym8.app.

The complaint should include a description of the problem and data identifying the Account.

The Service Provider will consider the complaint and provide a response within 14 days.

§9 Liability

The Service Provider is liable to Consumers for the compliance of the service with the contract under the terms specified in the Act on Consumer Rights.

In B2B relations (entrepreneurs), the Service Provider's liability is limited to the amount of the semester fee paid.

The Service Provider is not responsible for the content of notes and data entered by Users or for educational decisions made based on them.

The Service Provider reserves the right to brief technical breaks necessary for system maintenance.

§10 Intellectual Property and Sharing

The Application and its source code are subject to legal protection. It is prohibited to modify or copy them without the Service Provider's consent.

The Application allows for the transfer of subject information between Users (P2P). The Service Provider acts as a technical intermediary and is not responsible for content exchanged between Users.

§11 Amendments

The Service Provider may amend the Terms and Conditions for important reasons (e.g., changes in law, introduction of new paid features).

Users will be informed of changes via e-mail at least 14 days in advance.

§12 Final Provisions

These Terms are governed by Polish law.

For matters not regulated herein, the provisions of the Civil Code and the Act on Consumer Rights shall apply.

Consumers have the option to use out-of-court complaint and redress mechanisms (e.g., via the ODR platform: http://ec.europa.eu/consumers/odr).
